adm.jpg

The declaration of birth must be made within two weeks of the birth, within the territory of the municipality where the birth took place.

Who declares the birth?

  • If the birth takes place in a hospital, the declaration must be made by the father, the mother, or both. If they are unable to do so, it must be made by the clinic’s director or deputy director.
  • If the birth takes place outside of a hospital, the declaration must be made by the father, the mother, or both parents or, if both parents are unable to do so, by the doctor, or in the absence of a doctor, by the midwife, or in the absence of a midwife, by the people who assisted in the birth.
If the parents are not married and a prenatal recognition document has not been made, then the two parents are required to appear together before the administration of the place of birth so that a paternal recognition document can be made at the time of the declaration.
